Transnational Trade Union Rights (TTUR)

Description

Several years ago, the ETUI established this network for assistance in legal research in the area of fundamental social rights, including transnational trade union rights, composed of academic experts in labour law issues.
Previous outcomes of their research include, amongst others, an ETUI report on 'The legal framework for European industrial relations' focusing on 1. the legal framework of the EU social dialogue, 2. legal questions in relation to the EWC activities, 3. a legal framework of transnational industrial action, 4. the general issue of fundamental freedom of association.
In recent years the TTUR research group assisted the ETUC and the ETUI-REHS in the elaboration of critical analysis on the EU Charter of fundamental social rights of 2000. A short, political version was published in 2002 by the ETUI in more than 8 EU languages. A comprehensive, updated version has been published in 2006 by NomosVerlag.

Since 2004/2005 the TTUR research group has prepared a critical analysis of the social dimension of the draft European Constitutional Treaty in particular in relation to aspects relevant to trade unions and workers' rights. Due to the no vote to the referenda in France and the Netherlands, the TTUR research group is working on a revised version, including the different options currently discussed in Europe to get out of the political blockage. This later work will support the preparatory work for the 2007 ETUC Congress.
Future work issues will cover the debate on transnational collective bargaining system and transnational collective action based on the recent ECJ developments as well as on the EU Commission initiatives.
