Transnational Trade Union Rights

Several years ago, the ETUI-REHS established this network in order to be assisted in legal research in the area of fundamental social rights, including transnational trade union rights.

Previous outcomes of their research include amongst others an ETUI-REHS report on 'The legal framework for European industrial relations' whereby they looked at the following four aspects: 1) the legal framework of the European social dialogue and the agreements emerging from it, 2) certain legal questions in relation to EWC's agreements 3) the legal framework of transnational industrial action and 4) the general concept of the fundamental freedom of association.  

In previous years, the group assisted the ETUC and ETUI-REHS in the elaboration of a critical legal analysis on the EU Charter of Fundamental Rights, adopted in Nice December 2000. The work on this analysis has been finalised in 2003.

The main issue of the research agenda of the group covering 2004 to 2005 was the elaboration of a critical legal analysis of the new Constitutional Treaty in particular in relation to aspects relevant to workers and trade union rights. As a consequence of the negative vote to the referendum on the European Constitutional Treaty in France and in the Netherlands, the group envisages to publish in an revised, more adapted form the commentary prepared on the draft Constitutional Treaty probably in 2006.

Future work will cover the issues of transnational bargaining system and transnational collective action based on the current developments of the EJC case law and the initiative of the European  Commission.
