Legal Experts Network - NETLEX
The EC has produced and is likely to continue to produce European labour law, which is of direct interest of workers and their representatives, including trade unions. Information and advice on the elaboration, implementation and interpretation of EC labour law is thus of crucial importance for the ETUC and its member organizations.
Description
To improve its legal capacities, the ETUC is therefore, amongst others, constantly strengthening the functioning of its trade union legal experts network, NETLEX. One way forward is certainly to continue to 'sectoralise' and 'regionalize' the NETLEX by creating specific networks for certain sectors of economy or regions in Europe but at the same time ensuring their link to NETLEX. The major functions of this network are firstly, to assist the ETUC Secretariat, Executive and Standing Committees in the legal aspects of the policy priorities relating to EU matters and, secondly, to foster the contacts between the legal experts of the member organizations in order to monitor and follow up the implications of and the new developments in EC litigation and regulation. The three main working areas are:
1) Litigation/Implementation and revision of EU instruments
2) Employment contract aspects
3) Fundamental social rights and transnational trade union rights
In addition to the primary aim of information exchange (amongst others via a renewed NETLEX internet page), the network also constitutes a forum to conduct short and medium term research tasks either internally or in cooperation with external legal experts. The research agenda will be liable to alterations following the policy priorities put forward by the EU institutions and the ETUC. Major guiding documents will hereby be the ETUC Resolution and action programme adopted at the 10th ETUC Congress (May 2003- Prague) and the European Social Partners Work Programmes of 2003-2005 and 2006-2008, as well as the initiatives deriving from the EU Social Agenda. The ETUI-REHS will in line with its own objectives assist in establishing the links between the NETLEX and the academic world (i.e. proposing and conducting research projects within the NETLEX framework, ensuring the participation of academic experts in the NETLEX working groups, etc) and will handle the overall coordination and servicing of the network.
Foreseen issues in 2006 and 2007 are amongst others: Data Protection, Restructuring, Insolvency, Services, Services of general interest, Implementation of the social acquis communautaire in the new member states, the Revision of EWC Directive, the revision of the Working time Directive, etc.
