Non-Discrimination

Article 13 EU Treaty has since it existence triggered the EU institutions to launch and also adopt several legislative instruments and policy programmes to combat discrimination in all its forms. Reference could be made to the important Directives of 2000 on non-discrimination in the employment field and on racial discrimination.

Description

It was followed in 2002 by a directive revising the equal treatment Directive 76/207/EEC. A codification of all equal treatment instruments is for the moment considered at EU level. Furthermore, the Commission issued a Green Paper on Equality and non-discrimination in the enlarged European Union. Also the European social partners intend to contribute actively to the realization of this fundamental right.  Reference could be amongst others made to their own EU social dialogue Work Programme 2003-2005 including initiatives on gender equality, old age, disability, harassment, etc.

Under this project, several aspects will be investigated such as:

• Report on the implementation of Directive 2002/73/EC on the implementation of the principle of equal

• Treatment for men and women as regards access to employment, vocational training and promotion, and working conditions. (foreseen for 2005)

• Sub-reports on the legal implementation of the Directives 2000/43/EC and 2000/78/EC, on the implimentation process, scope and definitions (I), on age and disability (II), on awareness raising, enforcement and litigation (III), published in 2004

•Sub-report on the legal protection against harassment in all its forms (foreseen for 2005)
